Patent
A patent is an exclusive right granted for an invention of an article, substance, or new method that offers a new way or new technical solution which can be reproduced, reprocessed for industrial use. Without the patentee’s prior consent, a third party is prohibited from manufacturing, selling, using or importing the patented products. An invention is patentable if it meets the following requirements:

●Non-obvious
●Subject to patentable matter
Taiwan adopts first to file principle. Under the said principle, the first applicant to file a patent application is entitled to obtain the patent. Hence, a patent application is strongly advised to be filed to occupy an earliest filing date before it is disclosed.
As Taiwan adopts absolute novelty, disclosing the invention to the public anywhere in the world before filing a patent application in Taiwan would prevent the inventor from obtaining a patent in Taiwan.
Trademark
A trademark is a word, device, symbols, colors, three-dimensional shapes, motions, holograms, sounds, or any combination thereof to be used on products, containers, packages, pamphlets, brochures, catalogues or other similar objects to identify the product from those offered by others.
Service Mark :
A service mark is used to identify the service from those offered by others.
a trademark application is strongly advised to be filed to occupy an earliest filing date before it is actually used for the reasons listed below:
If a trademark has been registered by a party other than the original proprietor, any use of the mark by the original proprietor under the services/goods the same as or similar to those designated under the prior trademark registration would be considered as trademark infringement.
If there is no registration for the mark, there is no enjoyment of exclusive right until the registration is obtained. If, for any reason, the trademark is not registered, the mark is not protected, which means anyone can use the mark.
Please note that it takes approximately one year from filing till registration, thus we strongly recommend our clients to register their mark(s) before they start using it/them due to the first to file Principle system practiced in Taiwan.
Copyright
Copyright is an exclusive right to reproduce, publish, or sell one’s original work of authorship. Typically, the duration of a copyright spans the author’s life plus 50 years. Most of the countries recognize copyright in any completed work, without formal registration.

required documents as following:
1. A Power of Attorney to be executed by the applicant/an authorized person on behalf of the company.
2. A copy of Certificate of Incorporation to be executed by the applicant/an authorized person on behalf of the company.
3. Declaration of ownership of the work creation.
4. Sample of the work creation.
5. Specification of the artwork signed by the owner/individual.
